STATEMENT: Marsy’s Law for Kentucky Response to Courier Journal Story on Privacy Language in Amendment 1

It is false that any police officer will be able to conceal their name. Marsy’s Law for Kentucky does not shield police officers’ identities, period. Marsy’s Law gives crime victims equal and enforceable constitutional protections.

Anyone who is made a victim of a crime when the police break the law will receive much stronger rights than they currently have. Amendment 1 includes language specific to Kentucky, developed through years of collaboration between state legislators, legal experts and local victim advocates. It does not include the privacy language at issue in Florida.

At least eight other states (Michigan, Texas, New Mexico, Idaho, California, Ohio, Nevada and Oklahoma) have constitutional language nearly identical to the privacy language included in Kentucky — some dating back more than three decades — and none have experienced a similar issue.
